Holiday Accident Claim
Things to Remember When Filing for a Holiday Accidents Claim

When you go on a holiday package tour and you encounter an accident or an injury along the way, you can file for a holiday accidents claim. You have the right to be paid for the emotional trauma you experience as well as the physical injury itself, especially if it were not your fault. In this article you will find useful tips on how to file this claim.

Document the accident itself if you can. If you have a camera or a video, take images of the accident site, the damage to the vehicles and the injuries inflicted on you. You can also get a medical certificate from the hospital where you had your wounds examined. A doctor’s prescription will also be helpful as well as any hospital records. Even if you suffer minor injuries, you still

need to report this.

You also need to get the names of the people who were involved in the accident. These can be passengers, drivers and witnesses. Try to get all their names and contact details as they can support you when you file for a holiday accidents claim. If you can possibly get a signed testimony of the witnesses, this will further boost your chances of getting the claim.

You can also file a complaint against the operator who gave you the holiday package tour. For this you will need evidence tour. This will include tickets and hotel accommodations you were provided with. Never throw away official receipts of your travel. Keep any evidence you have that prove you indeed availed of the tour package.

Get the help of a solicitor general as soon as possible, especially if you were on a holiday tour. The tour operator will do anything in its power not to pay your claim so a solicitor general will work on your behalf. When legal minds are present, people will be afraid to question or bend the law. This however entitles you to pay legal fees but try to see if your insurance company or the other party can pay for such. This will again depend on the laws of the country where the accident happened.

If you just visited the country where the accident happened without availing of a holiday package tour, you can file a case against the driver who caused the accident. But you will have to see what the laws of the country on such matter are. For this, you will need the help of a solicitor general as he or she knows what the policies are on holiday accidents. Provide the solicitor general with all the evidence you have and the details of the entire accident.

It is important to go to the authorities and tell them exactly what happened even if the accident was minimal. If you did suffer serious injuries, the hospital personnel would be able to supply all the necessary records you need as evidence. If you do not require hospitalization, a police report as well as testimonies of witnesses and pictures taken will help you in your claim. If you have contacted your insurance company regarding this matter, most likely, their representative will be around to take photos of the accident.

Remember that every traveler has rights to a holiday accidents claim especially if such a misfortune was not their fault.
